Public Property Q&A

How Do I Verify the Developer or Seller Has Authority to Sell?

Due Diligence & Contracts · 2025-10-25

Check the seller’s identity, company registration, directors, signing authority, land ownership, project rights and any mortgages or encumbrances. For a resale, match the seller to the title and confirm marital, estate or power-of-attorney issues. For off-plan property, verify who owns the land, who is building, who receives payments and which company promises completion. Similar brand names are not proof that the contracting entity has the assets or authority.

The purpose of due diligence is not to make every risk disappear; it is to identify who owns what, what is permitted, what is promised, who must perform and what remedy exists. Slow down when documents, names or explanations do not match.
